1. WHO WE ARE AND HOW THESE TERMS APPLY

Krayber is a wholesale fleet and facility supply business located at 13777 I-40 West, Amarillo, TX 79124. We sell diesel exhaust fluid, lubricants, greases, shop and janitorial supplies, and related products by the case and by the pallet to businesses and to the public.

These Terms apply to your use of the Site and to every order you place with us, whether you order online, by phone, as a guest, or through a business account. By using the Site or placing an order you accept these Terms and our Privacy Policy, which explains how we handle your information. If you do not agree, please do not use the Site or order from us.

If you order on behalf of a company or other organization, you confirm that you are authorized to accept these Terms for it, and “you” in these Terms includes that organization.

2. ELIGIBILITY AND ACCOUNTS

You must be at least 18 years old and able to enter into a binding contract to order from us. You can check out as a guest or with a free account.

You sign in to your account with a one-time code sent to your email address or with your Google account. Keep your email account and Google account secure, because anyone who can read your email or use your Google account can sign in as you. You are responsible for activity under your account, and you agree to tell us promptly if you believe someone else has used it. Keep the name, business, billing, and shipping details on your account accurate and current.

We may suspend or close an account, or refuse an order, if an account is used in breach of these Terms, for fraud, or where an invoice is seriously overdue.

3. PRODUCTS, DESCRIPTIONS, AND AVAILABILITY

We work to describe every product accurately. Product names, specifications, pack sizes, pallet quantities, and safety information come largely from the manufacturer and can change when the manufacturer changes them. Images show a representative product; packaging, labels, and colors may vary from what is pictured.

Each product page shows the item’s current stock status and, where we have it, an estimate of when it ships. Some products are sold only in a minimum quantity or in multiples, such as full cases; the product page shows this before you add the item to your cart. Availability is not guaranteed until your order is accepted. We may limit the quantity of any product you can order, and we may discontinue a product at any time.

Brand names and trademarks belong to their manufacturers and are used on the Site only to identify the products we sell. Unless a product page says otherwise, Krayber is an independent reseller.

4. PRICING AND TAXES

All prices are in US dollars. The price shown on a product page is the price you pay for that item at checkout, unless your account has been approved for account pricing, in which case your account prices are applied in your cart and at checkout. Shipping and any applicable sales tax are added at checkout and shown before you pay. Prices can change at any time, but the price in effect when you place an order is the price you pay for that order.

Account pricing is specific to the approved account and cannot be transferred to another customer.

If a product is listed at an obviously incorrect price or with an incorrect description, we may cancel the affected part of your order, whether or not it has been confirmed, and refund anything you have paid for it. Where practical, we will contact you first and offer the item at the correct price.

Sales tax is charged where the law requires it, based on the shipping address, and is calculated at checkout; where state law requires, tax also applies to shipping charges. Where we are not required to collect tax, you are responsible for any use tax your state imposes. If your business is tax-exempt or buys for resale, send us a properly completed exemption or resale certificate before your order ships. We apply the exemption once we have accepted the certificate, we may decline a certificate we have reason to believe is invalid, and you are responsible for any tax, penalties, and interest that result from its misuse.

5. ORDERS, ACCEPTANCE, AND CANCELLATION

Your order is an offer to buy. The confirmation email you receive acknowledges that we received the order; we accept it when we ship the products or, for Net 30 accounts, when we issue the invoice. We may refuse or cancel all or part of any order before it ships, including when a product is unavailable, when a price or description was wrong, when we suspect fraud or an unauthorized payment, when a product cannot lawfully or safely be shipped to your address, or when an order exceeds quantity limits or your approved credit. If an item becomes unavailable after you order, we tell you promptly. If we cancel all or part of a paid order, we refund the full amount you paid for the cancelled items, including any shipping charge when the whole order is cancelled, to your original payment method within 7 business days. Our acceptance of your order is expressly conditioned on your agreement to these Terms.

You can cancel any order at no charge any time before it ships, including an item we order from a supplier for you. Contact us or call 832-305-7988 with your order number as soon as possible. Cancelled, unshipped items are refunded in full, including shipping, within 7 business days. Once an order has shipped, it is handled under our Returns & Refunds policy.

6. PAYMENT

We accept Visa, Mastercard, American Express, Discover, and most debit cards. Your card is charged when you place the order. Payments are processed over an encrypted connection by our payment processor; your full card number is sent directly to the processor and is never stored on our systems. Online checkout takes card payment. If your account has been approved for Net 30 terms, your orders can instead be invoiced: place them by calling 832-305-7988 with your account details, as described under Business accounts and Net 30 terms. Every order is a one-time purchase: we do not offer subscriptions or automatic reorders, and we never ask for your card details by email.

By submitting payment details you confirm that you are authorized to use that payment method and that the billing information you provide is accurate. If a payment is declined or later reversed, the order is not accepted or may be cancelled, and we may suspend account privileges until the balance is settled.

7. BUSINESS ACCOUNTS AND NET 30 TERMS

Accounts are free, and individuals and businesses use the same account. Account pricing and Net 30 credit terms are available to qualifying businesses after a credit review. We may ask for business details, trade references, a tax ID, and, for some accounts, a personal guarantee. Approval, credit limits, and payment terms are at our discretion and can be changed or withdrawn at any time, including by requiring payment in advance for future orders.

Unless your invoice says otherwise, invoices are due in full 30 days from the invoice date. Please tell us about any invoice discrepancy within 15 days of the invoice date. Overdue balances accrue interest at 1.5% per month (18% per year) or the highest rate permitted by law, whichever is lower; if any charge is ever found to exceed the lawful maximum, it is reduced to that maximum and any excess is credited or refunded. While a balance is overdue we may hold shipments and suspend credit terms, and you agree to pay our reasonable costs of collection, including attorney’s fees, to the extent permitted by law. These Terms form part of the credit terms you accept when your account is approved.

If we cancel all or part of an order invoiced to a Net 30 account before it ships, we remove the charge from that invoice and send you a credit memo within 7 business days; if you have already paid the invoice, we refund the amount to you within the same time rather than holding it as a credit, unless you ask us to apply it to your account. Refunds for items you return from a Net 30 order are applied as a credit against the invoice or your account balance.

8. SHIPPING AND DELIVERY

We ship from Amarillo, Texas, to business and residential addresses in the contiguous United States. We do not ship to Alaska, Hawaii, or PO boxes. Shipping is $5.99 per order, and free when the merchandise subtotal is over $50.00, including pallet orders (an order of exactly $50.00 pays $5.99). The shipping charge is shown before you pay. Our Shipping page summarizes these terms.

In-stock orders leave our warehouse within 1 to 2 business days (Monday to Friday, excluding holidays) of our receiving your completed order, meaning your payment or credit approval and everything we need to ship it. Delivery usually takes another 1 to 3 business days after shipment, depending on your location. We do not offer expedited shipping. Where a product page shows a different ship estimate next to the price, that estimate applies to that item. If we cannot ship within the time stated, or within 30 days where no time is stated, we tell you before that time runs out, give you a new ship date or tell you that we cannot, and offer you the choice of waiting or cancelling the delayed items for a full refund. If the new date is more than 30 days after the original one, or we cannot give you a definite date, we cancel and refund the delayed items unless you tell us you would rather wait. If we cannot ship by a revised date, we send a renewed notice by that deadline; unless you expressly agree to a further delay by that deadline, we cancel and refund the unshipped items. Transit times after shipment are estimates and are not guaranteed.

We choose the carrier and method: small orders ship by parcel, and heavy or bulky orders, such as fluids in drums or totes and pallet quantities, ship by freight. Contact us for pallet pricing and to arrange delivery details before you order. Freight deliveries require someone to receive and sign for them. Liftgate delivery and residential pallet delivery are available; tell us what assistance you need when arranging the order. The same flat-rate and free-shipping policy applies to parcel and pallet orders. We provide tracking for every order and do not offer local pickup.

Some products, such as aerosols and certain flammable or corrosive chemicals, are regulated for transport and ship by ground only. We cancel and refund any item we cannot lawfully ship to you.

Title to and risk of loss for the products pass to you when the carrier delivers the shipment to the address you provided. If a shipment is lost in transit, let us know and we will trace it with the carrier and replace or refund it.

9. DAMAGED, DEFECTIVE, MISSING, OR INCORRECT ITEMS

Please inspect your order when it arrives. For freight deliveries, note any damage or shortage on the carrier’s delivery receipt before you sign, and refuse a pallet that is severely damaged.

Report damaged, defective, missing, or incorrect items within 48 hours of delivery through our contact page or by calling 832-305-7988, with your order number and photos of the damage and packaging, and keep the packaging until the claim is settled. We will replace the items or refund you in full at no cost to you, and we arrange and pay for return shipping if we need the item back. See our Returns & Refunds policy for the full process. Nothing here limits rights you have under applicable law.

10. RETURNS AND REFUNDS

Return window. Request a return authorization within 30 days of delivery. The full process is in our Returns & Refunds policy, which forms part of these Terms.

What can be returned. Eligible products that are unopened, unused, in their original sealed packaging with all components, and in resalable condition.

What cannot be returned, unless the item arrived damaged or defective or we sent the wrong item:

  • Opened or used products, including any fluid, lubricant, grease, chemical, or cleaner whose seal has been broken.
  • Products marked hazardous material, whether opened or sealed.

Everything else we sell, including pallet quantities and items we order from a supplier for you, can be returned under the same eligibility conditions. If an excluded item arrives damaged, defective, or incorrect, contact us for instructions; do not ship hazardous or leaking goods back yourself.

Return shipping and fees. Krayber pays return shipping for all eligible returns, including pallet and freight returns. We provide a prepaid label or arrange a pickup, and we do not deduct return freight from your refund. There is no restocking fee.

Refunds and exchanges. We inspect the return and issue the refund within 7 business days of its arrival, to your original payment method; inspection is included in that period. Orders paid on invoice are credited to your account. Original outbound shipping is refunded when the return is because of damage, a defect, or our error. Exchanges and all other return details are handled as described on our Returns & Refunds page.

Nothing in this section limits rights that you have under applicable law.

11. WARRANTIES AND DISCLAIMERS

Products carry the manufacturer’s warranty, if the manufacturer offers one. Krayber is not the manufacturer and gives no written warranty of its own. The manufacturer’s terms govern its warranty and the remedy it provides; we will help you make a claim, and a valid warranty claim can be accepted after the return window has closed. You can ask us for a free copy of the applicable warranty before you buy. If a product we ship does not match the description you ordered against, we replace or refund it as described under Damaged, missing, or incorrect items. Images are representative, and general advice from us about a product’s suitability for your equipment or application is not a warranty: confirm suitability against the manufacturer’s label, specifications, and safety data sheet before use.

Except as expressly stated in these Terms or required by law, the products and the Site are provided “as is” and “with all faults.” To the fullest extent permitted by law, Krayber disclaims all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade.

Some states do not allow limits on implied warranties, so some of the above may not apply to you. We do not guarantee that the Site will be available without interruption or free of errors, and we may correct errors and change the Site at any time.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Krayber and its owners, employees, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, downtime, or damage to vehicles, equipment, or property, arising out of or relating to the Site, these Terms, or any product we sell, whether the claim is in contract, warranty, tort (including our negligence), or otherwise. To the same extent, our total liability for all claims relating to an order is limited to the amount you paid us for the product or order that gave rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by a defective product or by our negligence, for our gross negligence or willful misconduct, or for any other liability that cannot be limited by law. Some states do not allow the exclusion or limitation of incidental or consequential damages, so some of the above may not apply to you.

13. PRODUCT USE, SAFETY, AND COMPLIANCE

You are responsible for choosing products that are suitable for your equipment, vehicles, and application, and for using, storing, handling, transporting, and disposing of them according to the manufacturer’s label and instructions, the product’s safety data sheet, and all applicable federal, state, and local laws and regulations, including workplace hazard-communication rules if you are an employer. Safety data sheets come from the manufacturer. We provide the current safety data sheet for a hazardous chemical with the first shipment to a business account and again with the first shipment after the manufacturer updates it, and you can request one at any time through our contact page or by calling 832-305-7988.

You are responsible for any permits or licenses that your use of a product requires, for keeping products away from children and from anyone not trained to use them, and for not using a product in equipment or for a purpose the manufacturer does not approve.

If a manufacturer recalls a product you bought from us, we will contact you using your order details, pass on the manufacturer’s instructions, and replace or refund the recalled items as the recall provides.

Some products may expose you to chemicals that are known to the State of California to cause cancer, birth defects, or other reproductive harm. Where a manufacturer has told us a product requires a California Proposition 65 warning, we show the warning before you buy, and it also appears on the product’s label or packaging. Learn more at www.P65Warnings.ca.gov (opens in a new tab).

We sell for delivery within the United States only. You may not export products you buy from us without complying with US export laws.

14. CUSTOMER REVIEWS AND CONTENT YOU SUBMIT

Signed-in customers can review the products we sell. You keep ownership of what you write. By submitting a review or other content, you give Krayber a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute it, in full or in excerpt, on the Site. Published reviews show your first name and last initial. We do not use your name, likeness, or other personal information in advertising without your separate consent.

Reviews must be honest and based on your own experience with the product. We do not pay for reviews, offer anything in exchange for a particular rating, or write reviews ourselves; anyone with a personal or business connection to Krayber must say so in their review, and fake, purchased, or automatically generated reviews are prohibited. Reviews reflect individual customers’ experiences. Our team checks each review before it is published, applying the same rules to positive and negative reviews, and we never decline a review because it is critical. We decline or remove a review only if it contains confidential information, another person’s personal information or likeness, or content that is defamatory, harassing, abusive, obscene, discriminatory, clearly false or misleading, unlawful, or unrelated to the product, or if we reasonably believe it is fake.

Messages you send through the contact form are used to respond to you, as described in our Privacy Policy.

15. USING THE SITE AND OUR CONTENT

The Site and its content, including text, images, logos, layouts, and software, belong to Krayber or its licensors and are protected by copyright and trademark law. You may use the Site to browse and buy products for your own use or your business’s use.

You may not copy, scrape, or crawl the Site with automated tools except as permitted by our robots directives, or use its content to train machine-learning models; reproduce or republish its content commercially; interfere with its security or operation; use it to send unsolicited messages; provide false identity or payment information; or use it for any unlawful purpose.

The Site relies on service providers for payments, our e-commerce platform, customer sign-in, address suggestions, and advertising measurement, and it may link to other websites. Those providers’ services are governed by their own terms, and a link is not an endorsement. Our Privacy Policy explains how we share information with our service providers.

16. INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Krayber and its owners and employees from claims, losses, and expenses, including reasonable attorney’s fees, that arise from your misuse of a product, your breach of these Terms, your violation of any law, or content you submit to the Site that violates these Terms or another person’s rights.

17. GOVERNING LAW AND DISPUTES

These Terms and every order are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

If you have a problem with an order, please contact us first; most issues are resolved quickly and informally. Any dispute that we cannot resolve informally will be brought exclusively in the state or federal courts located in Texas, and you and we each consent to the jurisdiction of those courts; venue is as provided by law. Krayber is located in Potter County, Texas. If you are a consumer, nothing in this section takes away protections of the mandatory consumer laws of the state where you live.

18. CHANGES TO THESE TERMS

We may update these Terms from time to time. When we do, we post the new version on this page and change the “Last updated” date at the top. Changes apply only from the date they are posted: the version in effect when you place an order applies to that order and to any dispute about it. Continuing to use the Site after a change means you accept the updated Terms for future orders.

19. GENERAL TERMS

  • Entire agreement. These Terms, our Privacy Policy, our Returns & Refunds policy, our Shipping page, and the details of your order are the complete agreement between you and Krayber for your purchases. Terms printed on your purchase order or other documents do not apply unless we have agreed to them in writing.
  • Doing business electronically. You agree to do business with us electronically. Placing an order or clicking to accept these Terms has the same effect as your signature, and we may send order confirmations, invoices, notices, and other communications about your orders and account by email or by posting them on the Site; these satisfy any requirement that a communication be in writing. The phone number you give at checkout is used for delivery updates.
  • Events beyond our control. We are not responsible for delays or failures caused by events outside our reasonable control, such as carrier disruptions, severe weather, supplier shortages, labor disputes, or government actions. We will tell you about any significant delay and you may cancel affected items that have not shipped.
  • Your legal rights. Nothing in these Terms waives or limits any right that cannot be waived or limited under applicable law, including the Texas Deceptive Trade Practices Act.
  • Severability and waiver. If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it.
  • Assignment. You may not transfer your rights under these Terms without our written consent. We may transfer our rights to a successor to our business.
